Prohibited Items Policy

The Solid Waste Division (SWD) is committed to operating a safe and user-friendly Web site that promotes the sale or exchange of items that might otherwise be thrown away. To this end, the SWD prohibits the listing of a wide variety of items that might be deemed harmful, offensive, or illegal.

The listing of prohibited items offered below is a sample only and not intended to be exhaustive. The SWD reserves the right to prohibit the listing of any item, at any time, if the site administrator, at his or her sole discretion, determines that the item is harmful, offensive, or illegal.

In addition, the site administrator may, at his or her discretion, temporarily or permanently bar a user from accessing the Online Materials Exchange if the user has listed an item that is deemed harmful, offensive, or illegal.

The decision of the site administrator to remove an item or to suspend a user from the site is final and not subject to appeal or review.

IMPORTANT: LISTING ITEMS THAT ARE DEEMED HARMFUL, OFFENSIVE, OR ILLEGAL MAY SUBJECT YOU TO CRIMINAL OR CIVIL PENALTIES.

  • The Solid Waste Division reserves the right to refer any potentially illegal listing (including, but not limited to fraudulent items, weapon sales, and pornography) to the appropriate legal authority for prosecution. The Solid Waste Division is committed to assisting the police and prosecutor in any investigation into illegal activity that may have occurred on this site.

  • If you list items in violation of this policy, or should you continue to do so after having been warned or requested not to by the site administrator, the Solid Waste Division reserves the right to pursue criminal or civil penalties against you (including, but not limited to prosecution for computer trespass).

It is impossible to list all items that might be considered harmful, offensive, or illegal. Users are requested to use their common sense when deciding whether to post an item that might fall into these categories.

Take these steps to find out if your item can be listed on the Online Materials Exchange:

  • First, review the Online Materials Exchange's listing policy. These guidelines will help you properly list items and understand what is allowed on the Online Materials Exchange.

  • Second, if you are still unsure about listing an item, contact the site administrator.

Even if you offer to give away for "free" (rather than sell) a prohibited item, this will not relieve you of liability or absolve your from the responsibility of complying with the User Agreement. This applies to both user and buyer.

The list below is updated from time to time and is incorporated by reference into the user agreement. These guidelines do not constitute legal advice. If in doubt, check with law enforcement agencies, an attorney or with a copyright, trademark or other rights owner for clarification. The Online Materials Exchange has also adopted certain policies regarding prohibited items, regardless of the legality of the item.

As an Online Materials Exchange user, you are ultimately responsible for making sure that buying or selling your item(s) is legal in the eyes of the law. If you think you've spotted an item on the Online Materials Exchange that is not allowed, please contact the site administrator.
