FIRE PROTECTION DISTRICT NO. 40

PROPOSITION NO. 1
AUTHORIZING PROPERTY TAX LEVY FOR FIRE AND EMERGENCY SERVICES

The Board of Commissioners of King County Fire Protection District No. 40 adopted Resolution No. 369 proposing to levy a regular property tax of One Dollar and 00/100 ($1.00) per One Thousand Dollars ($1000.00) of assessed value upon all the taxable property within the District in 2003 for collection in 2004. This shall not be construed to authorize an excess levy and shall be subject to otherwise applicable statutory dollar rate limitations. Shall the proposition be:

EXPLANATORY STATEMENT

King County Fire Protection District 40 has placed a proposition on the September 16th, 2003 ballot to authorize the property tax levy rate to return to $1.00 per $1,000 of assessed valuation. The proposition is presented to voters pursuant to Initiative 747, which otherwise limit property tax revenue to 101% of the previous year’s revenue, regardless of the authorized dollar rate limitation of $1.00, which has been in effect since 1990.
This proposition meets the requirements of Initiative 747, which was enacted by the voters of the State of Washington in November of 2001, mandating that any increase in property tax revenue of more than 1% over the previous year be approved by the voters.
Approval of this proposition would allow the maintaining of the current level of services provided by Fire District 40. Rejection of the proposition would lead to the loss of almost $450,000 in projected tax revenue in 2004.

STATEMENT FOR

The community served by the Fire District #40, expects and deserves continued fire protection, emergency medical services, and life safety programs of the HIGHEST QUALITY.
To preserve this high standard of service this proposition is asking Voters to authorize the return to the full funding rate and present level of Fire District 40 services. This would allow the Fire District to receive the statutory amount of $1.00 per $1,000 assessed valuation for the 2004 tax year.
The YES vote on Proposition No. 1 ensures Fire District #40 would have the full resources to adequately support the recent expansion of our local population base and Homeland Security needs.

RESOLUTION NO. 369
AUTHORIZING ELECTION REGARDING TAX LIMITATION

A RESOLUTION OF THE BOARD OF COMMISSIONERS OF KING COUNTY FIRE PROTECTION DISTRICT NO. 40 OF KING COUNTY, WASHINGTON, PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE DISTRICT AT AN SPECIAL ELECTION TO BE HELD THEREIN IN CONJUNCTION WITH THE STATE WIDE PRIMARY ON SEPTEMBER 16, 2003, A PROPOSITION WHICH WOULD AUTHORIZE REMOVAL OF THE 106% LIMITATION ON THE REGULAR PROPERTY TAX LEVY SET FORTH IN R.C.W. 84.55.010 FOR KING COUNTY FIRE PROTECTION DISTRICT NO. 40 FOR THE CALENDAR YEAR 2004.

WHEREAS, King County Fire Protection District No. 40 is charged with the responsibility for furnishing fire protection, and certain other emergency services; and
WHEREAS, said District has experienced growth in population and property improvements over the past few years, with a resultant growing demand for fire prevention and suppression services, and other emergency services; and
WHEREAS, it is the judgment of the Board of Commissioners of this District that present service levels may become compromised in 2004 and subsequent calendar years unless the tax levy limitation of R.C.W. 84.55.010 is removed by a vote of the qualified electors of the District; and
WHEREAS, such limitation of services would be detrimental to the general public interest and welfare; now, therefore

BE IT RESOLVED BY THE BOARD OF COMMISIONERS OF KING COUNTY FIRE PROTECTION DISTRICT NO. 40 that there shall be submitted to the qualified electors of the District for their ratification or rejection, at a special election to be held in conjunction with the State wide primary on September 16, 2003, the question of whether or not the limitation on the regular property tax levy set forth in R.C.W. 84.55.010 should be removed for the levy to be made in 2003 for collection in 2004, and the Director of Elections of King County is hereby requested to find that an emergency exists, to call a special election as aforesaid in the form of a ballot title substantially as follows:

KING COUNTY FIRE PROTECTION DISTRICT 40

PROPOSITION 1: AUTHORIZING PROPERTY TAX LEVY FOR FIRE AND EMERGENCY SERVICES

Shall King County Fire Protection District No. 40 be authorized to levy a regular property tax of One Dollar and 00/100 ($1.00) per One Thousand Dollars ($1,000.00) of true and fair valuation, to be levied in 2003 for collection in 2004?
This shall not be construed to authorize an excess levy and shall be subject to otherwise applicable statutory dollar rate limitations.

BE IT FURTHER RESOLVED by the Board of Commissioners of King County Fire District 40 that King County Elections Department is hereby notified of the District’s intent to participate in the King County State Voters pamphlet for the September 2003 primary and the November 2003 general election.

ADOPTED by the Board of Commissioners of King County Fire Protection District No. 40 at a regular open meeting thereof this 13th day of March 2003.
