Washington State Law provides:

  1. An adopted person over the age of 21 or a birth-parent or member of the Birth Parent's family, may petition the Superior Court in the County-of-Adoption to appoint a Confidential Intermediary to search for the Birth Parent(s) or adopted person.
  2. As a Birth Parent, you may request an uncertified copy of the original Birth Certificate from the Sealed File. Be sure to inform them that you are the Birth Parent requesting a copy of the original Birth Certificate. Include $15.00 fee and the following information:
  3. Non-identifying information may be disclosed by:
    1. The Department of Social & Health Services
    2. The Adoption Agency which handled the Adoption
    3. The Court in which the Adoption was granted
  4. Information required and fees:
    1. A Certified Copy of a Court Order to Open a Sealed File is required. At the time the Adoption information was received, the original Birth Certificate was placed in a Sealed File. This information cannot be released without a Court Order from the Superior Court that granted the Adoption.
    2. CHS must have a $13 fee for each certified copy of the Birth Certificate requested.
    3. CHS must have a $15 fee to open and review an Adoption Sealed File. [RCW 26.33.330 and WAC 246.491-990]

Remember your rights vary from state to state. If you are researching outside Washington State, check that state's laws regarding adoption. Public libraries, university law libraries, government documents libraries and local government law libraries (i.e., city, county, parish, etc.) will be able to provide the current state laws. Please be aware that very few government agencies can or will be able to conduct this research for you. In addition, many charge a fee for research and/or copy services. Expect your research to be time consuming; in addition, be forewarned that the cost rises commensurate with how much research you have agencies or professional researchers do. If you are on a budget, learn to conduct the research yourself.
