1.0 SUBJECT TITLE: Stormwater Pollution Control Manual

2.0 PURPOSE:

To establish water pollution prevention measures for residents, businesses, and other organizations within unincorporated King County to reduce polluted runoff from leaving their site and entering surface waters or ground waters.

3.0 INDIVIDUALS AND ORGANIZATIONS AFFECTED:

3.1 Businesses, organizations, public agencies, and property owners within unincorporated King County.

3.2 Department of Natural Resources and Parks Water and Land Resources Division, or their successor agencies.

4.0 REFERENCES:

5.0 DEFINITIONS:

5.1 "Best Management Practices" shall mean the best available and reasonable physical, structural, managerial, or behavioral activities, that when used independently or in combination, eliminate or reduce the contamination of both surface and ground waters.

5.2 "WLR" shall mean the Water and Land Resources Division, or its successor agency.

5.3 "Businesses, residents or other organizations" shall mean businesses, organizations, public agencies, and all persons or entities occupying or owning property within unincorporated King County.

6.0 POLICIES:

6.1 Chapters 3 and 4 of the Stormwater Pollution Prevention Manual contains reasonable water pollution prevention measures that shall apply to all businesses, residents and other organizations in unincorporated King County.

6.2 The Water and Land Resources Division's goal through the Stormwater Pollution Prevention Manual is to present source control best management practices for pollution prevention, as they are widely recognized as the least costly and most efficient and effective means of protecting and improving the quality and beneficial uses of our water resources.

6.3 The Water and Land Resources Division will rely, as much as possible, on education and technical assistance to promote compliance with the Stormwater Pollution Prevention Manual.

6.4 The Stormwater Pollution Prevention Manual shall be available for reading and for purchase at the Water and Land Resources Division and available for reading at King County Libraries and on line here.

6.5 The provisions of this Public Rule are exempted from the rule of strict construction and shall be liberally construed to give full effect to the objectives and purposes for which the Rule was adopted.

6.6 If any provision of this Public Rule is held invalid, the remainder of the Public Rule shall remain unaffected and shall continue in full force and effect. If the application of any provision of this Public Rule to any person or property is held invalid, the application of that provision to other persons or properties shall remain unaffected and shall continue in full force and effect.

7.0 PROCEDURES:

7.1 Reviews the King County Stormwater Pollution Prevention Manual and revises it if necessary.

7.2 Conducts site visits to confirm compliance and implementation of stormwater Best Management Practices.

7.3 Implement the applicable best management practices contained in Chapter 3 of the King County Stormwater Pollution Prevention Manual.

7.4 Implement the applicable best management practices contained in Chapter 4 of the King County Stormwater Pollution Prevention Manual.

8.0 RESPONSIBILITIES:

8.1 The Water and Land Resources Division is responsible for:
8.1.1 Issuing revisions of the Stormwater Pollution Prevention Manual as new information becomes available;

8.1.2 Providing on-site consultations to businesses and other organizations to assist in implementation of pollution prevention best management practices; and

8.1.3 Determining compliance with the Stormwater Pollution Prevention Manual.

8.2 The businesses or other organizations are responsible, at a minimum, for:

8.2.1 Implementing applicable pollution prevention best management practices;

8.2.2 Demonstrating that the best management practices comply with the Stormwater Pollution Prevention Manual; and

8.2.3 Maintaining the best management practices presented in the Stormwater Pollution Prevention Manual.

8.3 The residents of King County are responsible for implementing applicable residential best management practices
